Barcelona´s Court of Appeal handed down its Judgment of 16 March 2016 whereby the appeals lodged by the construction companies against the Judgment delivered by the First Instance Court number 24 of Barcelona dated 5 September 2013 with regard to the collapse of part of the quayside at the new Prat Quay on 1 January 2007 are successful and this last Judgement reversed. Barcelona´s Port Authority started judicial proceedings seeking compensation of about Euro 98 million from the construction companies for property damages and business interruption. The claim was in part accepted by the First Instance Court num. 24. However, the  Barcelona changed the criteria and concluded that construction companies executed their own works in accordance with the Port Authority’s specific assignments. None of the said companies took control nor globally coordinated the whole project since the Port Authority did not order any of them to do so in their respective contracts.
