COVID’19 outbreak: prohibition on entry at all Balearic Islands ports/marinas for recreational yachts (pleasure or commercial)

As a consequence of the declaration of the state of alarm/emergency in Spain last Saturday March 14 (Royal Decree 463/2020), caused by the COVID-19 outbreak, and the inherent need to manage the health crisis situation, last Tuesday March 17 the Minister of Transport of the Spanish Government issued out an Order (TMA/247/2020) establishing the transport measures applied to the connections between Spanish mainland and the Balearic Islands. The aforementioned Order also foresees in its article 1 (prohibitions), among others, the prohibition for all recreational vessels, pleasure or commercial (charter), to enter any ports of the Balearic Islands, regardless its place of origin. The Government may authorize disembarking only for exceptional humanitarian, medical care or public interest circumstances. This prohibition entered into force today March 19 at 00:00 hours and will remain and be effective until the end of the state of alarm/emergency period or, otherwise, until there are circumstances that justify a new Order modifying the current terms. Recent debate: The Balearic Port Auhtority repair&refit rate. By Miguel Ángel Serra

Last November 18, 2019 the Resolution of the Balearic Port Authority (APB) was published in the Spanish Official Gazette approving the so-called ‘Tasa de actividad’, which consists of a fee on the business activity of companies and sole traders rendering repair and refit services to yachts in those Balearic Islands Ports under the jurisdiction of the State, that is, the ports of Palma and Alcúdia (Mallorca), the port of Mahón (Minorca), the port of Ibiza and the port of ‘La Savina’ in Formentera. The fee was due to come into force by last January 1st, 2020 but on December 18th, the APB Council decided to suspend it temporarily due to the strong unease and controversy it caused in the local yachting industry. The rate ranges from 1.5% to 3.5% on the turnover of the Companies rendering such services within the service areas of those ports and the specific percentage will depend on the kind of authorization held (permanent or temporary) and whether the services are being undertaken in those facilities expressly dedicated to repair&refit activities or in other different port facilities.
